Terms of Service

1. Agreement

By accessing or using any service provided by Smart Web App Solutions (“we”, “us”, “our”), the trade name of Abrahams Management Consultancy Service, a sole proprietorship registered with the Department of Trade and Industry (Business Name No. 8256192), Quezon City 1117, Philippines, including smartwebappsolutions.com and Smart Church (smartwebappsolutions.com/products/smart-church), you agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

We provide web development services, AI-powered automation tools, and related software products. Specific product features and limitations are described on the relevant product pages and within your subscription plan.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use our services.

4. Purchases and billing

• Smart Church is a yearly subscription with a 30-day free trial. One payment covers a full year and there is no auto-charge. Hosting, updates, backups, and support are included. If a subscription lapses, the church's data is kept and access returns on renewal.
• Smart Church is also offered as a one-time license: one payment for the software with the first year of hosting and support included, then a yearly hosting and support fee from the second year. If that fee is not paid, access pauses and the church's data is kept until it is renewed.
• Smart School is sold as a one-time purchase. There is no free trial and no subscription.
• For Smart School, an optional annual Care plan covers hosting, updates, backups, and support. It is billed yearly and is free during any founding pilot period. You may cancel the Care plan at any time. Cancellation stops future charges; you keep the software you purchased.
• We reserve the right to change pricing with 30 days' notice.
• Refunds follow our Return and Refund Policy at smartwebappsolutions.com/refund-policy: a 7-day money-back guarantee on a new purchase, full refunds for duplicate or incorrect charges, and project refunds based on work completed.
• Complaints and payment disputes are handled under our Dispute Resolution Policy at smartwebappsolutions.com/dispute-resolution.

Smart Marketing Teamis a one-time purchase that licenses one business to use the employee setups for as long as we offer the product. It does not renew and has no subscription. The setups are for your own business; you may not resell, share, or republish them. The employees run inside your own ChatGPT account, which is governed by OpenAI's terms and usage limits.

5. Acceptable use

You agree not to:

• Use our services for any unlawful purpose.
• Publish content that is defamatory, hateful, or violates the rights of others.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use automated tools to scrape, crawl, or extract data from our services.
• Resell or redistribute our services without written permission.

6. Content and data

• You retain ownership of all data you upload or enter through our services.
• You are responsible for the accuracy of the data you provide, including member records and attendance information.
• We do not guarantee that exported reports or data will be free of errors resulting from inaccurate input.

7. Intellectual property

Our services, branding, and proprietary technology are owned by Smart Web App Solutions. You may not copy, modify, or reverse-engineer any part of our services.

8. Limitation of liability

To the maximum extent permitted by law, Smart Web App Solutions is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your right to use the services ceases and your data will be handled in accordance with our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or through our services. Continued use after changes constitutes acceptance.
